There are still a few months until this part of the new law will take effect so the governor could decide to take action and rectify the language in the reform bill so that victims would not be shortchanged. Car insurance insiders have stated that there are no issues with the new law at all. They have stated that they would not take advantage of the verbiage and deny claims.
There is also a section which states that an emergency medical condition that a person has will allow them to get the $10,000 benefit in the PIP protection. However, there is not a clear definition of the term or how each victim will be evaluated as to whether or not they meet the criteria.

There needed to be stricter licensing guidelines for clinics and other medical facilities to help to make sure that they are operating properly and are not committing fraud. After this happened, a lawsuit was filed against the company. The trial was ruled on by a jury after 20 days in court. The jury found in favor of the auto insurance company. They stated that none of the six accident victims had incurred expenses that would be allowed to get compensation.
The family members who were helping to provide help and care to the automobile accident victims should have presented the proper documentation to the insurance company. The insurance company needs to be shown that the victim did incur the expenses for the in home care that they received.
The case took place in Michigan which is a no fault insurance state so accident victims are entitled to medical care without a lifetime cap after they have been injured in an automobile accident. Most of these individuals pled guilty. In this instance, the defendants will most likely get a lesser sentence for pleading guilty then having the matter proceed any further and going to trial.
The investigation into the crime ring started three years ago. There had been a pattern of staging accidents and then scamming automobile insurance companies from 2002 to 2012. The investigation involved many different agencies that worked very hard to coordinate the effort so that they could finally disband the crime ring and stop the insurance fraud from continuing any longer. In total, there were 289 counts against all 21 men and women. The charges ranged from insurance fraud to burglary. This crime ring had been allegedly operating in and around the county for years and posed a huge threat to its economy.
The man who is the alleged head of the crime ring is named Kelechi Chukwueke . He appeared in court on Tuesday and pled guilty to 12 of the 61 counts that he had been charged with. The crime ring that he was allegedly running ran under the radar for a long time.
